If a loved one has been detained for immigration reasons, acting quickly and with the right information can make all the difference. In Canada, the Immigration Division of the Immigration and Refugee Board of Canada (IRB) reviews the legality of the detention and decides on possible release.

Reasons a Person May Be Detained
The Canada Border Services Agency (CBSA) may detain an individual if:
- They do not have valid documents to remain in Canada.
- They are considered a flight risk (not likely to appear for hearings or removal).
- There are security concerns or suspicions of criminality.
- Their identity needs to be confirmed.
Detention Review Timelines
Every detained person has the right to a detention review hearing before the Immigration Division:
- Within 48 hours of the initial detention.
- If detention continues, every 7 days thereafter, and then every 30 days.
